Definitions

Company: means OPYO di VS SRL with registered office in Via Garibaldi 1/A – 70016 Noicattaro (BA), registered in the Bari company register (REA no. BA – 586115 and VAT no. 07850580726-EORI CODE  IT07850580726) owner of the domain name of this Site and manager of the electronic commerce platform operating on the Site, accessible through the same.

Seller: means the third-party legal entity independent of the Company, clearly identified on the Site and in the Platform, which uses the Site and the domain name granted to it for use by the Company, and which offers the Goods for sale to the public via the Platform itself.

The Seller, therefore, is solely responsible for the correct execution of the sale of the Goods to the Customer, and has declared that he is the legitimate owner of the Goods offered for sale, that the same complies with current Italian and European legislation, and that he is authorized to carry out e-commerce activities.

Site: means this website on which the Platform operates.

Platform: means the electronic commerce platform operating on the Site and accessible through it, through which the Seller is technically authorized to sell the Goods. Access to the Platform is free for Customers and in general for any user.

Good: means the product and/or service offered for sale by the Seller through the Platform.

Customer: means the adult natural person or legal entity registered on the Site who, by submitting the Order, proposes to the Seller to purchase the Goods via the Site and pay the price via the Platform accessible via the Site itself. If the Customer is a consumer referred to in art. 3, co. 1 of the Consumer Code (Consumption Code), the same is subject to all the greater protection provisions provided therein.

Order: means the purchase proposal for a Good forwarded by the Customer to the Seller via the Site and the Platform, which the Seller can accept by giving specific communication to the Customer.

Contract: means the sales contract relating to a Good, which the Customer concludes directly with the Seller following the forwarding of the Order, its communication of acceptance by the Seller and the payment of the relevant price.

Consumer Code (Consumption Code): means Legislative Decree 6/9/2005, n. 206.

General Conditions of Sale (GSC): means these contractual conditions, published on this Site, of which the Customer can view and print a copy at any time, which have as their object the sale of the Goods by the Seller to the Customer.

Every purchase of Goods made through this Site and the electronic commerce platform is regulated by this document, and is configured as a distance sale pursuant to articles. 51 et seq. of the Consumer Code.

Purchase voucher or coupon: means a legitimation document that can be purchased by the Customer on the Site via the Platform and downloaded and saved in electronic form and/or printed in paper form, equipped with a unique identification code, which attributes to the Customer , for a maximum period of 90 (ninety) days from purchase, the right to purchase goods or use services of your choice at the physical location or shop of the Seller, for an equivalent value indicated in the voucher itself.

Procedure for purchasing the goods

The process of purchasing an asset consists of the following steps:

2.1. Customer Identification: the Customer must register on this Site by entering their details (personal identification data, physical and telephone number and any other information requested) and give the Company and the Seller valid consent to their processing and their communication to the carrier (courier) and to any third parties for the purposes set out in these general conditions of sale.

Once registered, to proceed with the purchase the Customer must enter their access credentials (username and password) and complete the Order form relating to the chosen Good.

2.2. Completion of the Order form: the Customer must carefully read and complete the Order form in electronic format on this Site.

The Order form will indicate in detail, in a clear and easily understandable way, before its confirmation by the Customer:

a) the essential characteristics of the Goods offered for sale by the Seller via the Platform;

b) the identification data and physical contact details of the Seller (in the case of an individual business, company; in the case of a company, company name or name; physical address of the main office and/or any secondary offices; telephone numbers; e-mail address) ;

c) the quantity of the Goods covered by the Order;

d) the total price of the Goods (including all applicable taxes and duties);

e) the costs of delivery of the Goods (with any additional costs).

f) the methods, address and delivery of the Goods;

g) the request to read and accept the General Conditions of Sale by the Customer;

h) the request to read and accept the conditions established for the exercise of the right of withdrawal by the Customer, as well as the methods, costs and times for returning the Goods and the related reimbursement of the Price already paid (where applicable) ;

i) any request to issue a commercial invoice;

l) the total price of the Order (including taxes, duties and shipping costs);

m) the payment method chosen by the Customer among those expressly indicated on the Site and provided by the Platform;

Upon completion of the Order form, the Customer may, before submitting the Order, print or save the same in electronic format.

2.3. Forwarding of the Order form and payment of the price: The Customer will forward the Order form with point and click mode, or by selecting a virtual button on the Site clearly and legibly displaying the wording "order and pay", or other similar action involving the explicit recognition by the Customer of the fact that the forwarding of the Order implies the obligation on his part to pay the price.

Payment of the total price of the Order is an essential condition for the Contract to be considered concluded and the order to be processed.

Once the order has been submitted and payment of the Price has been made, the Customer will receive, within the strictly necessary technical times, by e-mail, a communication confirming acceptance of the Order by the Seller and payment of the price, containing the summary of the contents of the Order itself.

If the Customer has requested to collect the Goods directly from the Seller ("collect in store" option), the tracking code will not be communicated.

2.4. Conclusion of the Contract: the contract between the Customer and the Seller will be considered concluded with the receipt by the Customer of the communication of acceptance of the Order by the Seller and the payment of the relevant price.

2.5. Archiving of the Order: The Order form will be archived in the Platform's database for the period of time necessary for its execution and in any case within the legal deadlines.

2.6. Denial of execution of the Order and reimbursement of the Price: The Seller may refrain from executing the Order submitted by the Customer if the identification data entered by the Customer in the Order form are incomplete or incorrect. If this happens, the Customer will be informed, within the strictly necessary technical times, by email, of the reasons for the failure to conclude the Contract, and will receive a full refund of any Price already paid.

2.7. Unavailability of the Good: If, for any reason, the Good is no longer available from the Seller, the latter may temporarily suspend the execution of the Order by contacting the Customer by email within 5 (five) working days following the submission of the order form. The Seller will provide the Customer with all information regarding the expected times for restocking and delivery of the Goods and may also offer the Customer a Good with equivalent characteristics and value to replace the unavailable Good.

The Customer has the right, in this case, to withdraw from the contract and cancel the Order, rejecting any alternative proposal received from the Seller. If the payment of the Price has already been made, the Customer will receive a full refund of the sums paid according to the established times and methods.

Guarantees and indication of prices and products

On www.opyo.it only top quality branded products are offered for sale. These products are purchased directly by the Seller from fashion houses, manufacturers and retailers carefully selected for their rigorous quality controls.

The Seller does not sell used, irregular or lower quality products than the corresponding standards offered on the market.

However, the images and colors of the products offered for sale on www.opyo.it may not correspond to the real ones due to the Internet browser and monitor used.

The Seller, in the event of the Customer exercising the right of withdrawal, has the right not to accept the return or not to fully refund the sums paid for the purchase in relation to those products which do not have the relevant tag or which have been altered in their essential and qualitative characteristics or which have been damaged, as better clarified below.

 

METHODS OF PAYMENT

The accepted payment methods are credit card, PayPal, bank transfer and cash on delivery directly to the courier upon delivery.

Credit cards: Visa, MasterCard, American Express, rechargeable credit cards. The amount will be charged to the card at the time of purchase.

PayPal: to purchase online conveniently, without having to enter your credit card details on the site. The account will be debited upon completion of the order.

Bank transfer: upon confirmation of the order the Customer will receive all the Seller's banking information necessary to make the payment. Orders for which payment is not verified within 3 days will be cancelled. The Customer will receive a reminder of his order and will have to send the Seller the accounting copy of the payment made while waiting for confirmation, in order to avoid its cancellation.

Cash on delivery: ONLY IN ITALY method available for amounts under €4,999. At the time of delivery it will be necessary to have available in cash the exact amount of the order indicated in the shipping confirmation email; the courier cannot give change and does not accept checks. For any refund you must indicate a bank or postal account.

In the registration form you will be asked for the VAT number which will be applied according to the articles:

- National VAT 22%.

- NON TAXABLE VAT art 8/c

regular exporters. (to insert number of letter of intent received and number of registered letter of intent)

- VAT EXEMPT art 41 intra cee

- VAT EXEMPT art 8/a non-EEC

For customers who are part of these categories but have not registered their VAT number, the national VAT of 22% will automatically be applied to the order.

In case of payment by credit card, the financial information (for example, the credit card number or its expiration date) will be forwarded, via encrypted protocol, to Banca Popolare di Bari or to other banks, which provide the relevant remote electronic payment services, without third parties having access to them in any way. Furthermore, this information will never be used by the Seller except to complete the procedures relating to your purchase and to issue the relevant refunds in the event of any product returns, following exercise of your right of Withdrawal, or if it becomes necessary. prevent or report to the police the commission of fraud on opyo.it.

The invoice will be sent by email at the time of shipment indicating the package tracking code.

 

Right of withdrawal

The Customer has the right to withdraw from the contract concluded with the Seller, only in the case of faulty items, within two (2) days starting from the day of receipt of the products purchased on opyo.it.

To withdraw from the purchase it is possible to use the Return Form (conforming to the standard form pursuant to art. 49, paragraph 4 of the consumer code) to be filled in and sent directly to the email address info@opyo.it, or drawn up and send the Seller another explicit declaration of your decision to withdraw from the purchase by completing the return form which you can request at the email address info@opyo.it. If you choose, however, to send another declaration of withdrawal, the burden of proving the correct and timely exercise of the right of withdrawal will fall on the Customer.

Once the withdrawal from the contract has been exercised, the Customer must return the products to the Seller by handing them over to the courier for shipment within three (3) days starting from when he communicated the decision to withdraw from the contract to the Seller.

The only costs to be borne by him are those of returning (shipping the products to the seller) of the purchased products, unless the Seller has expressly exempted him from such costs at the time of purchase. You will be responsible in the event of loss or damage to the products during transport which is due to a negligent choice of the carrier and/or shipping methods.

The Right of Withdrawal - in addition to compliance with the terms and methods described below - is considered exercised correctly if the following conditions are also fully respected:

  1. the Return Form sent directly to the email address info@opyo.it or other explicit declaration of the decision to withdraw from the contract must be correctly completed and sent to the Seller within two (2) days of receipt of the products;
  2. the products must not have been used, worn or washed;
  3. the identification tag must still be attached to the products;
  4. the products must be returned in their original packaging;

And. the returned products must be delivered to the courier within three (3) days from when the decision to withdraw from the contract was communicated to the Seller;

  1. the products must not be damaged.

If the Right of Withdrawal is exercised following the methods and terms indicated above, the Seller will exchange the goods

The change of the items will be carried out in the shortest time possible and in any case, within fourteen (14) days from the date on which the Seller received the product, always after verification by the Seller of the correct execution of the terms and conditions indicated above .

If the methods and terms for exercising the right of withdrawal below are not respected, the Customer will not have the right to exchange the items. Within fourteen (14) days of sending the email communicating non-acceptance of the return, the Customer may choose to regain, at his own expense, the products in the state in which they were returned to the Seller, by communicating this to the Seller himself, according to the methods that will be communicated to him.

Terms and conditions for return requests:

- The security seal on the items to be returned must not be cut or broken

- The items must not have been worn, washed or altered and must not show any signs of use.

- Each item must be returned including all labels, packaging and original accessories (hangers, garment covers, etc.) received with the order.

- All footwear and accessories must be returned together with their original box, considered to all intents and purposes an integral part of the product. 

In the event that you receive defective goods, or that errors occur in shipments by Opyo, we ask you to follow the same instructions above.

- All returned items are subjected to inspection and must comply with all the parameters listed in the return procedure.

- Opyo reserves the right to refuse unauthorized returns.

Return times and methods:

After returning the products, the Seller carries out the necessary checks relating to their conformity with the conditions and terms indicated above. In the event that the checks are concluded positively, the Seller will send the Customer, via e-mail, the relevant confirmation of acceptance of the products thus returned. In the event that the checks are not concluded positively, the Seller will communicate to the Customer, via e-mail, the found existence of a decrease in value of the returned products, resulting from failure on his part to comply with the above conditions. At the same time, the Seller will communicate the possibility of regaining, at his expense, the products in the state in which they were returned to the Seller, in accordance with the provisions of the previous paragraph.

The exchange of the returned items is activated by the Seller in the shortest possible time and in any case within fourteen (14) days from the date on which the Seller received the returned product, after verifying the correct execution of his right of withdrawal and verification of the returned products.

Shipping

The goods will be shipped via our reference courier TNT , BRT/DPD, FEDEX and packaged in cardboard boxes.

The order shipment will be booked as soon as payment is received, in case of payment by bank transfer or PayPal. In case of cash on delivery payment, valid only for deliveries in Italy, the booking will take place immediately after completion of the order. The goods will then be collected, usually within the working day following the booking. Delivery is expected within the following times:

Shipments can be made exclusively to the countries indicated above, to the customer's premises indicated as the delivery address and cannot be addressed to post office boxes or post office boxes.

The costs of delivering the goods are the full responsibility of the Customer, and vary depending on the weight and volume of the Goods, the location of delivery and the ancillary services chosen. It will be possible to view the shipping costs when closing the order.

Following collection by the courier, the Customer will receive notification of the shipment of the goods together with the tracking code which will allow the status of the shipment to be monitored. From this moment the goods will no longer be under the responsibility of OPYO.

Shipments are not covered by insurance unless expressly requested by the customer and at the risk and expense of the latter. For shipments within Italian territory there is an overcharge of 0.3% of the total value of the goods, while, for shipments abroad, insurance costs are equal to 0.6% of the total value of the goods. If you wish to request insurance, please send an email to info@opyo.it specifying the reference order code.

Any delays in delivery cannot be attributable to OPYO.

 

RETURN POLICY - OPYO

The user can request a return within 2 days of receiving the order by following the instructions illustrated below:

  • Access the “my profile” section
  • Select the RMA section and click on request a new RMA for the product you want to return
  • Wait for the email with instructions
  • Send instructions to the end customer
  • Return the product within 3 days of receiving the aforementioned email

Right of withdrawal

The right of withdrawal, in addition to compliance with the terms and methods indicated above, is considered correctly exercised by respecting the following conditions:

- The products must not have been used, worn, washed or damaged.

- The identification tag must still be attached to the products.

- The products must be returned including all original labels, packaging and accessories received with the order, in their original packaging.

- The returned products must be delivered to the courier within fourteen (14) days from when the decision to withdraw from the contract was communicated to the Reseller.

- All footwear and accessories must be returned together with their original box, considered to all intents and purposes an integral part of the product.

- All returned items are subjected to inspection and must comply with all the parameters listed in the return procedure.

- FAILURE OR NON-CONFORMING PRODUCTS: In the event that you receive faulty goods, or that errors occur in shipments by Opyo, it is necessary to make the return request, according to the methods already indicated. No later than 2 days after receiving the order, you will be asked to describe the damage in detail and attach photos demonstrating the extent of it. In this case the shipping cost is borne by OPYO.

- Opyo reserves the right to refuse unauthorized returns.

OPYO reserves the right not to refund in the following cases:

  • Product not intact or with original packaging (shoe box, sunglasses case, dust bag) missing or damaged.
  • Absence of return code and/or order number.
  • Unauthorized returns or returns that have exceeded the required deadlines.
